Last week, the U.S. Court of Appeals for the Federal Circuit issued a precedential opinion in <a href="https://www.cafc.uscourts.gov/opinions-orders/24-1466.OPINION.11-12-2025_2602112.pdf"><em>Canatex Completion Solutions, Inc. v. Wellmatics, LLC, et al.</em>, No. 2024-1466 (Nov. 12, 2025)</a>, reversing the Southern District of Texas’s ruling that claims of Canatex’s U.S. Patent No. 10,794,122 are invalid as indefinite. The dispute centers on a downhole “releasable connection” tool with two parts, where the claims and specification refer at one point to “the connection profile of the second part.” Canatex contended that “second” is an obvious clerical error that should read “first,” consistent with the claim structure and the figures.

Canatex sued the Defendants in September 2022 and sought a preliminary injunction, which the district court denied before proceeding to claim construction. In December 2023, the court held independent claims 1, 7, and 13 indefinite for lacking an antecedent basis for “the connection profile of the second part” and declined to “correct” the language, reasoning the error was not evident and may have reflected an intentional drafting choice. The court entered final judgment on a joint stipulation, and Canatex appealed. While the appeal was pending, Canatex sought a certificate of correction from the PTO, which the Office denied in March 2025; the Federal Circuit did not view that denial as altering the intrinsic analysis.

The Federal Circuit reversed. Applying the demanding standard for judicial correction of claim language, the Court held that the error is evident on the face of the patent and that the only reasonable correction, based on the intrinsic record, is to replace “second” with “first.” The Court emphasized that the claims and specification describe the second part’s releasable engagement profile embracing—and upon release, disengaging—the first part’s connection profile; nothing in the intrinsic record supports a “connection profile” of the second part. The Court rejected alternative “corrections” that would materially change claim scope or rely on undefined components, and determined the prosecution history did not suggest a different interpretation. Because the error is obvious and the correction is textually simple and uniquely reasonable, judicial correction was proper. The Court reversed the indefiniteness ruling and remanded for further proceedings consistent with the corrected claims.
